“We’re seeing AI replicate the biases it was meant to eliminate,” Rood notes.

Moreover, the Equal Employment Opportunity Commission (EEOC) has clarified that algorithmic bias will be a key focus of their regulatory efforts in the coming years.

Failing to comply with these laws can lead to significant fines. In New York, penalties for non-compliance can reach $3,000 per day. These fines can accumulate quickly for smaller or mid-sized companies, putting the business in financial jeopardy. 

Beyond the direct monetary costs, companies face reputational damage if public audits reveal biased practices, eroding trust with current and potential employees.

To combat this, companies must take active steps to explain how AI tools are used and what safeguards are in place to prevent bias. Detailed explanations of the AI’s role in hiring can reassure candidates that they are being evaluated fairly.

Being upfront about AI’s limitations is equally important. Candidates who feel an algorithm unfairly dismissed them are more likely to turn to social media, creating a reputational crisis for the company. 

To mitigate this, organizations should allow candidates to appeal decisions made by AI and ensure human oversight is part of the process.

Given the risks associated with AI in HR, companies must implement a comprehensive AI governance framework to ensure compliance and ethical use of these tools. One of the most effective ways to reduce bias is to conduct regular third-party audits on all AI systems used within the company.
